Privacy Statement

This Privacy Statement describes the types of information that Doctors Direct Healthcare (“we” or “our”) collects through www.doctorsdirecthealthcare.net (collectively, with any and all successor sites thereof, the “Site”) and how we use, share and attempt to protect that information.  Doctors Direct Healthcare’s collection and use of information by and through the Site are governed by this Privacy Statement, the Website Terms and Conditions located at http://www.doctorsdirecthealthcare.net/terms.htm and any other rules, guidelines and additional terms referenced herein or therein (collectively, the “Terms and Conditions”).  This Privacy Statement does not govern our collection or use of information through any website or means, other than through the Site.

Capitalized terms used but not defined herein shall have the meanings ascribed to them in the rules and regulations promulgated for purposes of implementing the Health Insurance Portability and Accountability Act of 1996, as amended from time to time (collectively, the “HIPAA Rules”).

HIPAA Compliance
Doctors Direct Healthcare is a Business Associate of its client health plans and third-party administrators, each of which is a Covered Entity under the HIPAA Rules (collectively, “DDH Clients”) and has taken steps designed to enable Doctors Direct Healthcare to comply with the HIPAA Rules as they apply to Business Associates. Doctors Direct Healthcare does not access, use or disclose Protected Health Information for any purpose other than as required to perform its agreements with DDH Clients or as otherwise required or permitted by law. Doctors Direct Healthcare uses appropriate safeguards consistent with reasonable practices in the industry that are designed to ensure that Protected Health Information is not accessed, used or disclosed in an unlawful manner. Upon the expiration or earlier termination of an agreement with a DDH Client, Doctors Direct Healthcare returns or destroys all Protected Health Information that it created or obtained in accordance with the HIPAA Rules. In particular, in circumstances where return or destruction on any Protected Health Information is not feasible, Doctors Direct Healthcare continues to extend the protections of the HIPAA Rules to such Protected Health Information and limits further access, use and disclosure thereto and thereof to those purposes that make the return or destruction of the information infeasible.

What information do we collect and how is it used?
We collect two basic types of information through the Site: “Personal Information,” meaning information from which an individual can be readily identified, and “Aggregate Information,” meaning information from which an individual cannot be readily identified.

Personal Information.  When you contact Doctors Direct Healthcare through the Site, you may provide certain Personal Information through the Site, such as your name, e-mail address and other information.

We use Personal Information collected through the Site for the purposes of:

  • Providing you with health-related information; provided, however, that, the provision of all such information is subject in all respects to the Website Terms and Conditions for the Site located at http://www.doctorsdirecthealthcare.net/terms.htm.
  • Providing you with information about our products or services.

Aggregate Information.  When you visit the Site, the Site’s server examines the worldwide web (“Web”) browser that you use to access the Site in an effort to ensure compatibility between the applications available on the Site and your Web browser.  In addition, through the use of “cookies”, we automatically collect Aggregate Information about your visit to the Site, such as the Site pages that you visit, the operating system and screen resolution of the computer that you use to access the Site, and the IP address of the server on which your Web browser resides.

A “cookie” is a small piece of information sent by a Web server to a Web browser, which enables the server to collect information from the browser. Do I get to choose what information I disclose?
Yes, you can always choose whether or not to provide information on the Site.  However, if you choose not to disclose certain information, such as your e-mail address, telephone number, or fax number, you may not receive responses to inquiries you submit through the Site’s contact form located at http://www.doctorsdirecthealthcare.net/contact.htm (“Contact Form”).

Information We Share
We do not sell, rent, trade, distribute, or otherwise disclose information, including without limitation, Personal Information, provided by visitors to the Site and Aggregate Information, except as described in the Terms and Conditions.  Without limiting the foregoing, we may disclose Personal Information about you if we are required to do so by law or pursuant to legal process, in response to a request from government officials or law enforcement authorities or as necessary or appropriate in connection with an investigation of illegal activity.

In an effort to prevent unauthorized access to, and to maintain the accuracy and provide for the proper use of, any Personal Information that you provide through the Site, we have instituted physical, electronic, and operational safeguards that are designed to reasonably secure any such Personal Information from unauthorized use and access.

A Special Note about Children
Children are not eligible to use our services, and we ask that minors (under the age of 13) not submit any Personal Information to us.  If you are a minor, you can use this service only in conjunction with your parents or guardians.

The Site contains links to various websites that Doctors Direct Healthcare neither sponsors nor endorses and over which Doctors Direct Healthcare has no control (collectively, “Third-Party Sites”).  Any and all access to and use of Third Party-Sites by you is at your sole risk and responsibility, and Doctors Direct Healthcare shall have no responsibility or liability to you or any other party in connection therewith. When you click on a link to a Third-Party Site, you will no longer be transacting business through the Site.  Third-Party Sites maintain their own privacy policies; therefore, if you link to a Third-Party Site, you should consult that website's privacy policy before providing any Personal Information or otherwise using that website.

What if I need to change the Personal Information I previously disclosed?
You may change your Personal Information at any time.  You can update your Personal Information by contacting Doctors Direct Healthcare through the Contact Form located at http://www.doctorsdirecthealthcare.net/contact.htm.  Changes to your Personal Information may be made only through the Site.

Updates to this Privacy Statement
Doctors Direct Healthcare may, but shall not be obligated to, provide notices of changes to this Privacy Statement or other matters by displaying notices or links to notices to you generally on the Site.  Doctors Direct Healthcare will indicate near the top of this Privacy Statement when it was most recently updated.
